1/ General information

We are committed to respecting your privacy when using the www.immoferco.be website and to your rights to protection and control of personal data. For this reason, the purpose of this charter is to inform you in a complete and transparent manner about the nature of the personal data we collect and the use we make of this data. Your personal data is processed by :

The processing of personal data relating to this site is subject to Belgian law. In particular, they are subject to the Law of December 8, 1992 on the protection of privacy with regard to the processing of personal data and, from May 25, 2018, to European Regulation 2016/679 of April 27 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”).

2/ The data we collect

No personal data is automatically collected by the site itself. The only data we process is that which you voluntarily communicate to us, for example by choosing a language, filling in a contact or request form on the site, communicating with us by e-mail, etc… In this context, the personal data we may collect and process depending on your use of the site are as follows:

  • General personal information title, surname, first name, gender, date and place of birth, telephone number, postal address, e-mail address and IP address.
  • Your language preferences.
  • Description and postal address of your goods.
  • The characteristics of the properties you are looking for (your search criteria).
  • Other personal data that you actively provide, for example, by requesting “owner’s area” access on this website, in correspondence and by telephone.
  • Your location data.
  • Data about your activities on our website.
  • Data on your surfing habits across different websites (e.g. because our company is part of an ad network).

As far as possible, we also record the date on which personal data was communicated or on which certain adjustments were made to this data. The personal data recorded may also contain other information, such as your product and service preferences and/or information about your lifestyle choices (region, neighborhood, type of property you are looking for, etc.) which you have communicated to us in the course of our business relations. Any other data collected automatically is done so only by statistical tools, such as Google Analytics, and concerns only the date and time, your TCP/IP address, the brand and latest version of your browser, and the web pages consulted, but remains completely anonymous. We may also process data about you from third parties such as the media (immoweb, vlan, logicimmo, etc.). This data is only communicated to us following a request via the forms made available on their respective sites. We may also receive information about you from partners with whom we offer joint services or carry out joint marketing actions. Finally, we may receive information about you via social media, for example, when you interact with us on them. We protect all data obtained from third parties in accordance with the practices described in this charter. We also apply any additional restrictions imposed by the source of the data.

3/ Use of data

The personal data we collect are used for the following purposes :

  • to enable you to use the various features of the site, to provide you with the services you have requested, to record and respond to your requests or queries; and for any other purpose necessary for the performance of the contract you enter into with us by using our website and services;
  • send you, in particular by e-mail, the list of property listings corresponding to the criteria you are looking for (e-mail alerts) or information on our products and services, insofar as you have consented to this when registering.
  • to ensure the site’s computer security, and to prevent and combat any fraud or abuse.
  • to compile global statistics in order to improve our site and our services. However, we will only use your personal data in an aggregated form that does not allow you to be directly identified.

4/ Use of cookies

When you visit our website, you accept that cookies may be installed on your computer to record certain information. Our cookies do not identify you personally. They are primarily used to operate the site and improve your user experience, for example by remembering the language you have chosen. We use external components to enhance the user experience on our site (e.g. instant messaging system, virtual tours, video player, etc.). These cookies are subject to the respective privacy policies of these external services (for example, YouTube’s privacy policy).

5/ Data security

We take the security and confidentiality of your personal data very seriously. We make every effort to take appropriate technical and organizational measures to prevent any accidental or unlawful violation of your personal data, including destruction, loss, unauthorized disclosure, misuse, alteration or unauthorized access to data collected on our site, and thus ensure appropriate security and protect your personal data at all times. In the event of a proven violation of your personal data, Immo Ferco will inform you as soon as possible.

6/ Transfer of data to third parties

Your data will be used for internal purposes only and will therefore never be passed on or sold to other natural or legal persons, whether or not they are linked to our company. In addition, all our employees or independent service providers who have access to your data are bound by a strict duty of confidentiality. Your personal data may be communicated to subcontractors (e.g. banks, IT service providers, clouds, etc.), but only in the context of services performed on our behalf on the basis of our instructions and in accordance with this declaration. In the event that a third party is entrusted with the processing of collected data on our behalf, a data processing agreement will be concluded by us with the third party in question in order to guarantee the same level of protection and confidentiality of the personal data collected. In all cases, we remain responsible for the processing of such data. As for the storage of your personal data, we guarantee to select only service providers that comply with the provisions of the GDPR. Where applicable, we may transmit your personal data when required to do so by judicial or administrative authorities, but in compliance with applicable legislation.

7/ Retention period

We undertake not to retain your personal data beyond the period deemed necessary to achieve the purposes mentioned in this charter.

8/ Your rights

In accordance with the applicable legislation, you have the right to access, rectify, erase, limit processing, object to processing and the right to portability of your personal data at any time, as well as the right not to be subject to a decision based exclusively on automated processing, including profiling. Immo Ferco will notify each recipient to whom personal data has been communicated of any rectification or erasure of personal data or any restriction on the processing thereof, unless such communication proves impossible or would require a disproportionate effort. You may also withdraw your consent to the uses you have previously authorized at any time. The revocation of your consent for any of these uses of your personal data will only apply for the future and will not affect any processing already carried out. All requests must be accompanied by proof of identity. 9/ Updating

We reserve the right to modify the present charter in order to take into account any legal, jurisprudential or technical evolution. Only the latest version will prevail.
